Maria Francesca Fontanella graduated in law – with a specialization in legal practice – from the Università Cattolica del Sacro Cuore in Milan, after defending her dissertation in criminology entitled: “The corruption issue in EU criminal law”. Supervisor by Prof. Gabrio Forti. While still at university, Maria Francesca Fontanella attended the Katholieke Universiteit in Nijmegen through the Erasmus programme.
She has worked for the firm since 2000 and has been a member of the Milan Bar Association since 2003. Furthermore, Maria Francesca Fontanella has had the right of audience to appear before the Supreme Court of Appeal since 2016.
Maria Francesca Fontanella has gained relevant experience in corporate criminal law, having followed criminal lawsuits relating to corporate and financial crimes, bankruptcy crimes, crimes against public administration, crimes against property through embezzlement as well as criminal liability in the medical and health-care field. Likewise, she has acquired in-depth experience in environmental criminal law and in employer’s criminal liability for occupational disease, with particular emphasis on asbestos-related diseases, having participated in high-profile trials that have taken place in Italy over the last decade.
She also provides out-of-court assistance in the same areas in addition to entity liability as set out in LD n.231/01.
Maria Francesca Fontanella is a member of the single-judge supervisory board per legislative decree no. 231/01 for Bergamo Servizi s.r.l.; Sicura s.r.l.; ASRAB s.r.l.; A2A Integrambiente s.r.l.; AEVV Impianti s.r.l.; AEVV Farmacie s.r.l. in addition to being the president of the collegial supervisory board for Varese Risorse s.p.a.
Maria Francesca Fontanella has been a member of the Gruppo di Ricerca Criminologica (GRC) and a member of CSGP – Centro Studi “Federico Stella” sulla Giustizia penale e la Politica criminale, at Milan’s Università Cattolica del Sacro Cuore since its establishment. In this connection, she has collaborated – among other things – on the project launched in the 2007/2008 academic which was called: Esperienze d’avvio degli organismi di vigilanza ex D.lgs. 231/2001 (Experiences in setting up supervisory boards per LD 231/2001), whose results have been published in two volumes.
She has been a keynote speaker at conferences, seminars and roundtables.
Since 2011 she has held a teaching assistantship in corporate criminal law at the Specialization School for legal professions at the Università Cattolica del Sacro Cuore of Milan.
She was an adjunct professor in the postgraduate programme in corporate criminal law at the School of Law of the Università Cattolica del Sacro Cuore of Milan (teaching courses in criminal labour law) in the 2013-2014 academic year.
Since 2014 she has been a lecturer on the two-year programme in Techniques and deontological ethics for the registration of court-appointed defence lawyers run by the Gian Domenico Pisapia Criminal Bar Association.
Maria Francesca Fontanella has held legal clinics at the School of Law of the Università Cattolica del Sacro Cuore of Milan since the 2014/2015 academic year.
She is a member of the legal medicine editorial board of the Rivista Italiana di Medicina Legale e del Diritto in Campo Sanitario journal (new series).
Maria Francesca Fontanella has taught Criminal Law and Criminal Procedure at Scuola Legale Viggiani since 2014.
